Confusion Over Storm Water Compliance Imminent
Builders in 19 states and the District of Columbia will face a bundle of confusion over storm water regulations on March 10. That is the day the Environmental Protection Agency and states are supposed to have federal Storm Water Phase II regulations in place for projects disturbing one to five acres.
Unfortunately, Phase II permits will not be in place in Alaska, Arkansas, Connecticut, the District of Columbia, Idaho, Indiana, Maine, Massachusetts, Michigan, Minnesota, Mississippi, Nebraska, New Hampshire, New Jersey, New Mexico, Ohio, Rhode Island, Vermont, Wisconsin and Wyoming.
To ensure that they are in compliance, members in these states who are embarking upon construction projects are advised by NAHB to contact their storm water permitting authority and request coverage under the Storm Water Phase I permit.
